You can file an objection (Widerspruch) against a rejection notice within one month. The deadline starts when the notice is delivered to you. Do not let the deadline pass — filing an objection suspends the running of the deadline for filing a lawsuit.
Filing an objection
The objection (Widerspruch) must be received in writing by the authority that issued the notice. Including a statement of reasons is advisable, but not required to meet the deadline. The authority then reviews its decision again. If the objection is rejected, the deadline for filing a lawsuit follows (1 month).
Lawsuit before the administrative court
If your objection is rejected, you can file a lawsuit with the competent administrative court (Verwaltungsgericht). A lawyer is advisable — at first instance before the administrative court there is no requirement to be represented by a lawyer. Can I immediately submit a new application?
Yes — if you have resolved the reason for the rejection. However, an objection (Widerspruch) or a lawsuit is often more sensible than a new application, because with a new application the authority carries out the full examination all over again.
What does an objection procedure cost?
The objection itself is free of charge. If the objection is rejected, the applicant bears the costs. Lawyer's fees come on top — if you succeed, the authority can be ordered to bear the costs.
