Deadlines & Fiktionsbescheinigung: § 81 AufenthG explained (2026)

Whether you are legally protected while renewing your residence permit comes down to one date: the expiry date of your current permit. Anyone who files an application before that date remains lawfully resident by operation of law until the immigration authority (Ausländerbehörde) has decided. Anyone who is too late loses that automatic effect. This is governed by § 81 of the German Residence Act (Aufenthaltsgesetz, AufenthG). This article explains the two "fictions" (continuation fiction and permission fiction), the fiction certificate (Fiktionsbescheinigung) as proof, and what it means in practice for work and travel — every statement backed by its source.

The Residence Act knows two different "fiction effects" of filing an application. They sound similar but apply in different starting situations and have different reach.

Which one applies depends solely on your starting situation — not on a choice. The final assessment in the individual case is made by the competent immigration authority (die abschließende Prüfung durch die Behörde).

The practically most important case. A residence permit is only ever issued on application, under § 81 (1) AufenthG:

"A residence permit is issued to a foreigner only upon his application, unless otherwise provided." (own translation of "Ein Aufenthaltstitel wird einem Ausländer nur auf seinen Antrag erteilt, soweit nichts anderes bestimmt ist.")

If you file that application on time before expiry, the continuation fiction under § 81 (4) sentence 1 AufenthG applies:

"If a foreigner applies before the expiry of his residence permit for its renewal or for the issuance of a different residence permit, the previous residence permit is deemed to continue from the time of its expiry until the decision." (own translation of "Beantragt ein Ausländer vor Ablauf seines Aufenthaltstitels dessen Verlängerung oder die Erteilung eines anderen Aufenthaltstitels, gilt der bisherige Aufenthaltstitel vom Zeitpunkt seines Ablaufs bis zur Entscheidung der Ausländerbehörde als fortbestehend.")

This means: if your permit expires on the 30th of a month and you filed the application before that day, you remain lawfully resident without a gap afterwards — the old permit continues to have effect by operation of law until the authority has decided. A late appointment then does no harm, as long as the application was filed before expiry.

An important exception is in § 81 (4) sentence 2 AufenthG:

"This does not apply to a visa under § 6 (1)." (own translation of "Dies gilt nicht für ein Visum nach § 6 Absatz 1.")

A Schengen visa (short-stay visa under § 6 (1) AufenthG) therefore does not trigger a continuation fiction. Anyone who entered on such a visa cannot rely on continuation.

The second variant concerns people who are lawfully in Germany but without a residence permit — for instance after visa-free entry within the permitted period. For them, § 81 (3) AufenthG applies:

"If a foreigner who is lawfully in the federal territory without holding a residence permit applies for the issuance of a residence permit, his residence is deemed permitted until the decision of the immigration authority." (own translation of "Beantragt ein Ausländer, der sich rechtmäßig im Bundesgebiet aufhält, ohne einen Aufenthaltstitel zu besitzen, die Erteilung eines Aufenthaltstitels, gilt sein Aufenthalt bis zur Entscheidung der Ausländerbehörde als erlaubt.")

The difference from the continuation fiction is decisive: here no previous permit is carried forward, because there is none. The permission fiction initially secures only that your residence is deemed permitted. Whether it also carries a right to work or to re-enter does not follow automatically — that is narrower and to be clarified with the immigration authority in the individual case.

If the renewal application is filed only after the permit has expired, the continuation fiction does not arise on its own. The law then opens only a discretionary option for the authority — § 81 (4) sentence 3 AufenthG:

"If the application was filed late, the immigration authority may order the continuation effect to avoid undue hardship." (own translation of "Wurde der Antrag auf Erteilung oder Verlängerung eines Aufenthaltstitels verspätet gestellt, kann die Ausländerbehörde zur Vermeidung einer unbilligen Härte die Fortgeltungswirkung anordnen.")

Note the wording: the authority may order it — it does not have to. There is therefore no entitlement to continuation, only a possibility "to avoid undue hardship". Until such an order is made, the lawfulness of your residence may have a gap. While no decision has yet been made on your application, you need proof that you are lawfully resident. That proof is governed by § 81 (5) AufenthG:

"The foreigner is to be issued a certificate of the effect of his application (fiction certificate / Fiktionsbescheinigung)." (own translation of "Dem Ausländer ist eine Bescheinigung über die Wirkung seiner Antragstellung (Fiktionsbescheinigung) auszustellen.")

The Fiktionsbescheinigung is therefore not a new residence permit but the certificate of the effect of your application. It documents that one of the two fictions applies and serves as proof towards employers, authorities, or at border checks.

Practice/official form: On the official form it is usually ticked which fiction applies — that is, whether the certificate documents the effect under § 81 (3) (permission fiction) or under § 81 (4) (continuation fiction). This tick is administrative practice, not a separate statutory rule; but it determines the reach of the certificate. So check which box is ticked.

The fiction certificate is subject to a fee. Under § 47 (1) no. 8 of the Residence Ordinance (Aufenthaltsverordnung, AufenthV) it costs €13. It is thus separate from the renewal fee itself — the full overview is in Costs & fees.

Whether you may work or travel on a fiction certificate depends on which fiction is ticked — and, in case of doubt, is to be clarified with the immigration authority beforehand. The law gives no blanket answer here; the following points place the legal position generically:

  • With the continuation fiction (para. 4 s. 1) the previous permit is deemed to continue. As a rule, its previous effects continue as well — if your old permit allowed employment, that authorisation generally continues while the fiction lasts.
  • With a bare permission fiction (para. 3) the reach is narrower: it initially secures the lawfulness of residence but does not automatically say anything about employment.
  • Travelling abroad and re-entry are, in experience, delicate with a fiction certificate — not every state recognises it like a residence permit, and re-entry can be problematic. Clarify any planned trip with your immigration authority before leaving.

Re-entry into Germany — a distinction by type of fiction: While a continuation fiction (§ 81 (4) sentence 1 AufenthG) is running, the previous residence permit is deemed "to continue". Because that permit still has effect by operation of law, re-entry into Germany with a valid passport, the expired electronic residence permit (eAT) and the fiction certificate is generally possible. The position is different in other Schengen or third states: they do not necessarily recognise the fiction certificate like a residence permit, because the continuation is an effect of German law. The bare permission fiction (§ 81 (3) AufenthG) is narrower here too, as it carries no previous permit forward but only deems the residence "permitted" at first. Whether entry is allowed in the individual case is decided by the competent authority at the border. By when do I have to apply for renewal?

Before your residence permit expires. Only then does the previous permit continue to apply until the decision under § 81 (4) sentence 1 AufenthG. What matters is the date of filing the application, not the appointment — many authorities nevertheless recommend a lead time of a few weeks up to two or three months for scheduling.

What if I cannot get an appointment at the immigration office before expiry?

For the continuation fiction under § 81 (4) sentence 1 AufenthG, what counts is the application, not the in-person appointment. The law requires under § 81 (1) AufenthG only an application ("A residence permit is issued to a foreigner only upon his application …") and prescribes no particular form for it; under sentence 1 of para. 4, all that is decisive is that the application reaches the competent authority before the permit expires. A written or informal application received by the immigration authority in time — that is, before the expiry date — can therefore preserve the deadline for the continuation fiction, even if the in-person appointment only takes place later. Whether such an application suffices to preserve the deadline in the individual case is examined and decided by the competent immigration authority. What is the difference between the continuation and permission fictions?

The continuation fiction (§ 81 (4) s. 1) applies if you still hold a valid permit and renew before it expires — the previous permit is deemed to continue. The permission fiction (§ 81 (3)) applies if you are lawfully in Germany without a permit and apply for one — then your residence is deemed permitted. The continuation fiction is generally broader because it carries the previous effects forward.

What does the fiction certificate cost?

€13 under § 47 (1) no. 8 AufenthV. This fee is separate from the fee for the renewal itself.

How long is the fiction certificate valid?

The law sets no fixed validity period. § 81 (5) AufenthG only provides that a fiction certificate is to be issued — not how long it is valid. In practice, the immigration authority limits the certificate at its own discretion (typically to a few months). If processing your application takes longer, the authority issues a new fiction certificate on application. The time limit therefore follows from administrative practice, not from the statute; what governs is the date entered on your certificate.

What does the ticked box on my fiction certificate mean?

The ticked box shows which fiction applies — that is, whether the certificate documents the effect under § 81 (3) AufenthG (permission fiction) or under § 81 (4) AufenthG (continuation fiction). This determines the reach: with the continuation fiction, the previous effects of the old permit generally continue (for instance for work), whereas a bare permission fiction is narrower. Which fiction applies follows solely from the box that is ticked — not from the look or colour of the certificate. § 81 (5) AufenthG only provides that a fiction certificate is to be issued; the tick itself is administrative practice, not a separate statutory rule. What always governs is the box ticked on your certificate; in case of doubt, the competent immigration authority clarifies which effect applies.

What do the colours (green, blue, grey) of the fiction certificate mean?

The colour of the official form is pure administrative practice and legally irrelevant — on its own it says nothing about the effect of your certificate. What matters is solely the ticked box: whether the certificate documents the permission fiction (§ 81 (3) AufenthG) or the continuation fiction (§ 81 (4) AufenthG). § 81 (5) AufenthG only provides that a certificate of the effect of the application is to be issued (in conjunction with paras. 3 and 4) — not what colour a form has. So do not rely on the colour; read which box is ticked (see the question on the ticked box above). In case of doubt, the competent immigration authority clarifies which effect applies.

May I work on a fiction certificate?

That depends on which fiction is ticked. With the continuation fiction, the previous effects of the old permit generally continue — if it allowed employment, that generally continues. A bare permission fiction is narrower. Check your certificate and clarify the case with the immigration authority.

Can I travel abroad on a fiction certificate?

Travel and re-entry are, in experience, problematic on a fiction certificate, because it is not recognised everywhere like a residence permit. Clarify any planned trip with your immigration authority before leaving.

I filed the application late — what now?

Then the continuation fiction does not arise automatically. The authority may order continuation under § 81 (4) sentence 3 AufenthG only "to avoid undue hardship" — a matter of discretion, not an entitlement. Act at once and file the application without delay; more on this in Residence permit expired.

Does a Schengen visa trigger the continuation fiction?

No. Under § 81 (4) sentence 2 AufenthG the continuation fiction does not apply to a visa under § 6 (1) AufenthG (Schengen visa).

Does time on a fiction certificate count as lawful residence (for a settlement permit or naturalisation)?

With the continuation fiction (§ 81 (4) sentence 1 AufenthG), your previous residence permit is deemed to continue by operation of law — from expiry until the immigration authority's decision. Your residence therefore remains lawful during that time. For the periods required for a later settlement permit (Niederlassungserlaubnis — § 9 (2) sentence 1 no. 1 AufenthG requires, among other things, that one "has held the residence permit for five years") or for naturalisation (§ 10 (1) sentence 1 StAG requires having "lawfully had one's ordinary residence in Germany for five years"), no gap therefore generally arises while the continuation fiction is running. It is different with a bare permission fiction (§ 81 (3) AufenthG): it does not carry a previous permit forward but only deems the residence "permitted" — its reach is narrower. Whether and how individual periods are credited in a specific case is assessed by the competent authority.
