Securing Livelihood for German Citizenship: Income, Calculation, Exceptions
§ 10 (1) sentence 1 No. 3 StAG requires that livelihood for yourself and dependent family members is secured without claiming SGB-II or SGB-XII benefits. This article explains what "secured" means concretely, what income levels are typically required in 2026, what documentation is required, and when an exception for Bürgergeld recipients applies.
What Does "Secured Livelihood" Mean?
The authority examines three core questions:
- Is there SGB-II receipt (Bürgergeld) or SGB-XII receipt (social assistance)? — If yes, livelihood is not secured (unless an exception applies).
- Is income sufficient for the applicant and all dependent family members? — Calculation against the social assistance standard rate plus reasonable housing costs.
- Is income permanently secured? — Fixed-term contracts, frequent job changes, or unclear self-employment can raise doubts.
Minimum Income Levels 2026
There are no fixed amounts in the StAG. The authority calculates against the SGB-II need of the household community. Guidelines for 2026:
Single Without Children
- SGB-II standard rate adult: €563 (as of January 1, 2026)
- Reasonable cold rent: approx. €400–700 (location-dependent)
- Heating costs: approx. €80–120
- Health insurance: approx. €200–280
Minimum net income single: approx. €1,250–1,700/month depending on location.
Family with Two Children
- 2 adults standard rate: €1,014 (2×€506)
- 2 children standard rate: €357 + €471 (age-dependent)
- Housing costs family: €700–1,300
- Family health insurance
Minimum net income 4-person family: approx. €2,500–3,500/month.
These values are guidelines — the authority calculates on a case-by-case basis against the specific housing costs and family constellation.
Documentation for Livelihood Security
Employees
- Last 12 wage tax certificates (gross/net)
- Last 3 pay stubs
- Current employment contract copy (if fixed-term, termination date relevant)
- Last 3 bank statements as triangulation
Self-Employed
- Last 3 tax assessments
- Current income-expenditure statement (EÜR) or balance sheet
- Tax advisor certification of monthly average withdrawal
- Health insurance certificate (self-employed must be voluntarily insured)
- Pension insurance certificate
Self-employed individuals are scrutinized more critically in practice than employees — income must be consistently documented over several years.
Mixed Forms
- Partial self-employment + employee status: Document both income streams.
- Freelance activity: EÜR from the last 2 years + current accounting.
What Doesn't Count as Income?
- Bürgergeld (SGB II) and social assistance (SGB XII) — explicitly excluded
- Housing allowance (Wohngeld) — counts as supplementary social benefit but is usually not disqualifying
- Unemployment benefit I (ALG I) — counts as insurance benefit, generally creditable as secured livelihood
Family Constellation
When relying on family income, the household is viewed as a needs community:
- Homemaker without own income can secure livelihood with spouse's income if the total income covers the entire family's needs
- Studying spouse can be covered in a family application by the employed partner
Exceptions for Bürgergeld Recipients
§ 10 (1) No. 3 StAG recognizes exceptions when Bürgergeld receipt is not the applicant's fault:
Incapacity to Work
Recognized through pension insurance notification or severe disability ID. Complete incapacity to work is a clear exemption reason.
Care of Relatives
Home care of a severely ill relative (care level 4-5) is recognized in many federal states as unemployment not attributable to the applicant — with care level certificate from the care insurance fund.
Maternity Leave/Parental Leave
During maternity protection and statutory parental leave, Bürgergeld receipt is often creditable — the authority examines whether employment can be resumed after parental leave ends.
Illness Over Several Months
With documented long-term illness (medical certificate, sick pay receipt beyond 6 weeks), an exemption may apply.
Process When Livelihood is Questioned
If the authority has doubts about livelihood security during file review, it requests additional documentation:
- Prognosis letter from employer regarding contract extension
- Tax advance payment receipt as evidence of ongoing income
- School/care/illness certificate for exception constellation
- Written statement on livelihood strategy
With permanently lacking livelihood security, the application is generally rejected — the appeal path under § 70 VwGO is then available.
Fee Reduction for Bürgergeld Recipients
Those receiving Bürgergeld during the application period who naturalize under the exception rule can apply for fee reduction under § 38 (2) StAG — the authority fee reduces from €255 to around €50 per adult. The request is filed with the main application.
Frequently Asked Questions
Is Minimum Wage Income Sufficient for Naturalization?
Generally yes, for singles. At minimum wage (€12.82/hour, 40 hours/week), gross monthly income is approx. €2,220 → net approx. €1,600. This typically covers the SGB-II need of a single person. With family constellations it becomes tighter.
Am I Automatically Excluded if I Receive Bürgergeld?
Not automatically. With documented unemployment not attributable to you (incapacity to work, care, illness), exceptions apply. The application is supplemented with documentation.
What if My Contract is About to Expire?
Fixed-term contracts are problematic when near expiration. A written extension commitment from the employer or a new contract draft can help.
Is My Spouse's Income Counted?
Yes, if the family income covers the needs of the entire household community. The authority calculates at household level.
What Counts as "Reasonable Housing Costs"?
In most federal states, housing costs are "reasonable" when below the local rent index level. Very high rents (over 30% of net income) may be deemed unreasonable — rarely a knockout criterion.
Is Volunteer Work Sufficient as Livelihood Documentation?
No, volunteer work is not income. It can, however, have a positive effect on integration assessment.
